1. About Momzy

Momzy is a digital platform operated by Momzy Private Limited (“Momzy”, “we”, “us” or “our”) that provides access to postpartum and wellbeing services, including nutrition and dietetic support, lactation support, emotional wellbeing services, yoga and wellness services, and related products.

2. Eligibility and Account

Momzy’s services are intended for individuals aged 18 years and above. You are responsible for providing accurate and current information when creating and using your account. Accounts are for personal use and should not be shared or used on behalf of another person without authorization.

3. Our Services

Momzy facilitates access to independent professionals and service providers, including dietitians, lactation consultants, psychologists/therapists, and yoga or wellness professionals. The scope, recommendations and professional opinions provided during a consultation are the responsibility of the relevant professional.

4. Health and Medical Scope

Momzy is not an emergency medical service and is not a substitute for emergency medical care, diagnosis, treatment or ongoing medical care from a qualified healthcare provider. If you have an emergency or believe you require urgent medical attention, contact an appropriate emergency or healthcare service immediately.

5. Professional Consultations

You are responsible for providing the professional with information that is accurate and relevant to your consultation. Recommendations may vary based on your individual circumstances. You should use professional judgement and seek appropriate medical care where required.

Consultations may be conducted through video consultation technology, including Zoom. Momzy may record consultations for quality-control and service-improvement purposes. Where recording is used, users will be informed as applicable. Momzy does not retain the resulting audio/video recording after the relevant quality-control purpose is completed.

6. Plans, Payments and Appointments

Momzy may offer one-time consultations, support plans, programmes, subscriptions, products, discounts and promotional offers. Prices and applicable taxes, where any, will be displayed before purchase.

Payments may be processed through Razorpay or another payment provider made available by Momzy. Payment providers may process payment information in accordance with their own terms and privacy policies.

Subscription or recurring plans will continue according to the terms shown at the time of purchase until cancelled in accordance with the applicable plan terms.

A) Plans

• Plans once purchased cannot be cancelled or refunded.
• Each plan has its own validity period, which is shown on the plans page before purchase. The validity period begins from the date of purchase of the plan unless otherwise stated.
• The cancellation and rescheduling rules apply to each session within the plan purchased as mentioned in point B below.
• If you need a different expert, Momzy may help you change to another available expert without cancelling the package.
• If your chosen expert cannot provide the remaining sessions in your package, Momzy will offer an alternative expert for the undelivered sessions.

B) Consultations/Appointments

Consultations and appointments can be cancelled or rescheduled subject to the following:

• An appointment can be cancelled or rescheduled up to two times in total, provided the request is made at least 4 hours before the session.
• Cancellation or rescheduling is not permitted less than 4 hours before the scheduled session.
• Once the scheduled session time has passed, the appointment cannot be cancelled or rescheduled.
• Each session missed without attending is considered used and cannot be carried forward.

7. Late Arrival & No-Show

• If you join late, your session will continue only for the remaining scheduled time. The session end time will not be extended because of late arrival.
• If you do not join within 20 minutes of the scheduled start time, the session will be considered a no-show. No refund or rescheduling will be provided.
• If a technical issue prevents the session from taking place, Momzy will review the situation and may offer a reschedule depending on the circumstances.

8. If Your Expert Cancels

If your expert needs to cancel your confirmed session, you can choose:

• A reschedule with the same expert, subject to availability.
• A reschedule with another available Momzy expert.

9. Products and Orders

Momzy may sell food and other postpartum/wellness products directly through the platform. Product descriptions, prices, delivery information and applicable terms will be displayed at purchase. You are responsible for providing an accurate delivery address and contact information. Delivery may be fulfilled through third-party courier partners.

• Store orders can be cancelled until they are shipped.
• Once an order has been shipped, it cannot be cancelled or returned due to a change of mind.
• If you receive a damaged, incorrect or missing product, contact Momzy within 24 hours of delivery and share clear photographs of the product and packaging.
• If the issue is verified, Momzy will issue an appropriate refund. You will not need to return the product, and it will not be collected.
• Refunds, where applicable, are processed to the original payment method.

10. Refunds

Where a refund is applicable, it is calculated on the amount actually paid for the applicable consultation or product. Refund processing time may vary depending on the payment provider or bank.

11. Reviews and Ratings

Users may be able to submit ratings and reviews of services. Reviews should be genuine, lawful, respectful and based on the user’s own experience. Momzy may moderate, remove or restrict content that violates these Terms or applicable law.

12. Acceptable Use

You must not misuse the platform, provide knowingly false information, interfere with the operation or security of the platform, attempt unauthorized access, impersonate another person, infringe intellectual property rights, or use Momzy for unlawful purposes.

13. Intellectual Property

The Momzy name, logo, branding, platform, content, designs, text and other materials provided by Momzy are owned by or licensed to Momzy and may not be copied, reproduced, modified, distributed or commercially exploited without prior written permission, except as permitted by applicable law.

14. Third-Party Services

Momzy may rely on third-party technology and service providers, including payment, video consultation, cloud, analytics, communications and delivery providers. Your use of third-party services may also be subject to their own terms and policies.

15. Suspension or Termination

Momzy may suspend or terminate access to an account or service where reasonably necessary for security, misuse, violation of these Terms, legal compliance, or protection of users and the platform. Where appropriate, Momzy may provide notice and an opportunity to resolve the issue.

16. Limitation of Liability

To the extent permitted by applicable law, Momzy will not be responsible for losses arising from circumstances beyond its reasonable control, interruptions caused by third-party technology or services, or decisions made by users based on professional information obtained through the platform. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer-protection and other mandatory laws, courts having jurisdiction in Karnataka, India will have jurisdiction over disputes arising from these Terms. Any arbitration provision, if adopted, should be incorporated only after appropriate legal review.

18. Privacy

Your use of Momzy is also governed by our Privacy Policy, which explains how we collect, use, disclose and protect personal information.

19. Changes to These Terms

Momzy may update these Terms from time to time. Updated Terms will be made available through the platform or website. Your continued use of Momzy after an update may constitute acceptance of the updated Terms to the extent permitted by law.
